When Workers Compensation Isn't Enough

by Jo Rodriquez

Workers compensation is something that people often talk about a lot. By people, employers, and their employees. Employers think about it because they hope they never have to do it and employers think about it, not because they want to get injured on their jobs, but because they want to know that their employers have something in place in the event that they get injured and are unable to work for a period of time. Sometimes, the compensation received is just not enough. When the injuries are serious, an employee worries about the stability of their job and how much the compensation will cover.

Benefits

Workers are entitled to workers compensation if they were injured in their place of employment. The benefits the worker receives will depend on the severity of their injuries. An employee may suffer permanent or temporary disability or partial disability. The compensation covers the employee's medical bills and earnings they will normally earn when they are away from work for an extended period of time. Any employee who accepts workers compensation cannot file a lawsuit against an employer. You should understand the law before you jeopardize your chances of getting workers compensation.

Serious Injury

Workers compensation sometimes is not enough when you have suffered a serious, possibly life-changing accident. If your employer practices a soft management style, you will most likely have nothing to worry about. But if your employer practices a hard approach, it is possible that s/he is going to come up with an excellent reason, such as budget cuts, to release you from your employment contract. This is illegal, but the process can be long and tedious to refute.

Permanent Disability

Some injuries can leave an employee in a state where s/he is never able to work again. Whilst a workers compensation insurance will support the disabled employee for the remainder of their life, the money they receive is two-thirds of their usual salary. This is unfair because the employee is expected to survive on less and s/he has to make lifestyle changes as a result of the injury. It is unfair to the employee because s/he will have missed out on promotions and pay increases because of their diminished physical state.

Worker's compensation should meet your basic needs, though it may not be a luxurious sum of money. You may want to hire a law firm if you know your case will be lengthy, disputed, or deal with large sums of money for medical bills and wages.
